Should I send a without prejudice letter?
If you want to keep your job then send a grievance letter. If you want to leave with a fair exit package then send a without prejudice letter instead.
A decent without prejudice letter will normally get a reply from the employer either making a settlement offer and/or setting out their side of the story.
Even if no offer is forthcoming, a reply will flush out their counter arguments and help you to understand what extra evidence you may need to obtain in order to negotiate a decent settlement.
It may seem daunting to write your own without prejudice letter, but don’t worry, ‘without prejudice’ means off the record, so it can’t be used against you by your employer.
For example it couldn’t be used in a grievance procedure or disciplinary at work, and it could never be referred to by a judge in any Employment Tribunal.
